  • Non-exempt employees are entitled to 2 times their regular pay rate when they work more than 12 hours in a day or more than 8 hours on their seventh consecutive workday.

The State of California agrees with this sentiment and requires employers to provide employees with meal and rest breaks when their workdays last longer than four hours. Employees should receive a paid, 10-minute rest break for every 4 hours worked and an unpaid, 30-minute meal break whenever they work more than 5 hours.
